State police demotion upheld

In Gray v. Foley Civil Action No. 03-1748-D The Plaintiff a Massachusetts state police Officer was demoted from Major to Captain after allegations of interference in an OUI investigation were concluded. The demotion was subsequently challenged in Superior court and was upheld in Superior court as the court stated that “”pursuant to the colonel’s discretion to promote and demote staff officers under Article 3.3.2 [of the Rules and Regulations governing the Massachusetts State Police] and the General Laws.” The demotion was appropriate.
